ONYROS - LEGAL INFORMATION

Terms and Conditions.

01 - SELLER

Identity and contact details.

02 - SCOPE OF APPLICATION

Website use and purchases.

These Terms and Conditions govern access to the website, browsing of its content and, where available, the distance purchase of original artworks, Fine Art editions and other products expressly described on the relevant pages.

Before placing an order, customers are invited to carefully read these Terms and Conditions, the Privacy Policy, the Cookie Policy and the information provided on the artwork's product page.

Placing an order constitutes acceptance of the Terms and Conditions applicable at the time of purchase.

03 - ARTWORKS AND EDITIONS

Uniqueness, images and characteristics.

Each artwork is described on its respective product page by title, technique, support, dimensions, availability and other useful information.

Original artworks are unique pieces. Fine Art editions, when available, are produced in limited editions, numbered and signed as indicated on the product page.

Photographs are intended to represent the artwork as faithfully as possible, but slight colour variations may depend on the monitor, lighting conditions and the material characteristics of the artwork. Such variations do not constitute a defect when they fall within the normal perception of an artistic and handcrafted work.

Small differences, irregularities and traces of the artist's hand are inherent to the nature of the artwork and testify to its uniqueness.

04 - ORDERS

Confirmation and availability.

An order submitted by the customer constitutes an offer to purchase. The contract is considered concluded when the seller sends an order confirmation or expressly communicates acceptance.

Artwork availability is updated carefully, but an overlap of requests may exceptionally occur. If an artwork becomes unavailable after an order has been placed, the customer will be informed and any amounts already paid will be refunded.

The customer is responsible for the accuracy of the information provided, particularly the delivery address, contact details and billing information.

05 - PRICES AND PAYMENTS

Amounts and payment methods.

Prices are stated in Euros and include applicable taxes, unless otherwise indicated. Shipping costs, customs duties and other additional charges are shown or communicated before the purchase is completed.

The payment methods actually available are indicated during the purchase process. The seller does not retain complete payment instrument details handled by external payment providers.

Any invoice must be requested by providing complete and accurate information within the deadlines compatible with applicable tax obligations.

06 - SHIPPING AND DELIVERY

From my studio to your home.

Artworks are inspected and packaged according to their support, dimensions and destination.

Delivery times and costs may vary depending on preparation, destination and the service used. Any dates communicated are estimates, unless expressly stated to be binding.

The customer should check the external condition of the package upon delivery. In the event of visible damage or irregularities, it is advisable to accept the package subject to verification, photograph the packaging and contact the seller immediately, keeping all materials received.

For more information, please see the Shipping page.

07 - RIGHT OF WITHDRAWAL

Changing your mind about a purchase.

When the customer qualifies as a consumer and none of the exceptions provided by law apply, they may exercise the right of withdrawal within 14 days from the day on which they acquire physical possession of the goods.

To exercise the right of withdrawal, the customer must send, before the deadline expires, an explicit statement to info@onyrosart.it.

The goods must be returned intact, adequately protected and, where possible, in their original packaging. Unless otherwise provided by law or agreed, the direct costs of returning the goods are borne by the customer.

The refund will be made within the time limits established by law. The seller may withhold the refund until the goods have been received or until the customer has demonstrated that they have been shipped, whichever occurs first.

Exceptions

The right of withdrawal may be excluded, where provided by law, for goods made to the customer's specifications or clearly personalized. A dedication or other personalization requested by the customer may therefore affect the right of return: any exclusion must be communicated before the order is placed.

08 - LEGAL GUARANTEE

Conformity of the goods.

Consumers are covered by the legal guarantee of conformity provided for by applicable law.

A lack of conformity must be distinguished from the stated characteristics of the artwork, natural variations in materials, traces of the artistic process and visual differences already indicated in the description.

In the event of a problem, customers are invited to contact the seller promptly, providing photographs and information useful for assessing the issue.

09 - LIABILITY

Website availability and external causes.

The seller takes reasonable measures to keep the website up to date and accessible, but cannot guarantee the complete absence of interruptions, technical errors or temporary unavailability.

Responsibilities that cannot be excluded or limited under applicable law remain unaffected. Nothing in these Terms and Conditions limits any mandatory rights granted to consumers.

10 - INTELLECTUAL PROPERTY

The artwork and its rights.

Texts, images, photographs, graphics, trademarks and artworks featured on the website are protected by intellectual property laws.

The purchase of the physical artwork does not transfer copyright, reproduction, adaptation, publication, distribution or commercial exploitation rights, unless otherwise agreed in writing.

Reproducing or using images of the artworks for commercial purposes without authorization is not permitted.

11 - PERSONAL DATA

Privacy and security.

Personal data is processed as described in the Privacy Policy and, for tracking technologies, in the Cookie Policy.

12 - APPLICABLE LAW AND DISPUTES

Applicable law and consumer protection.

These Terms and Conditions are governed by Italian law, without prejudice to any mandatory consumer protection provisions that may apply in the country of residence.

For consumers, territorial jurisdiction is determined in accordance with applicable law and cannot be replaced by a less favourable provision.

For relationships that do not involve a consumer, any exclusive jurisdiction shall be: Perugia.

13 - UPDATES

Terms and Conditions version.

These Terms and Conditions may be updated to reflect regulatory, technical or commercial changes. The version applicable to a purchase is the one available at the time the order is placed.
